Scope of Application<\/strong><\/p>\n<p>1.1 These General Terms and Conditions (&#8220;GTC&#8221;) apply to all contracts for the rental of rooms for accommodation as well as all other services provided by Wrann Hotels GmbH (hereinafter referred to as the &#8220;Hotel&#8221;) in this context.<\/p>\n<p>1.2 These GTC apply to all hotels operated by Wrann Hotels GmbH.<\/p>\n<p>1.3 If the contractual partner is not the guest at the same time, they are obliged to transfer all obligations from the contract and these GTC to the guest.<\/p>\n<p>1.4 A contract is concluded exclusively on the basis of these GTC. Deviating conditions of the contractual partner shall not apply unless the Hotel expressly agrees to their validity in writing. <\/p>\n<p>&nbsp;<\/p>\n<p><strong>2. Definitions<\/strong><\/p>\n<p>&#8220;Accommodation Provider&#8221; refers to any natural or legal person who accommodates guests for a fee.<\/p>\n<p>&#8220;Guest&#8221; refers to any natural person who makes use of accommodation. The guest is usually also the contractual partner. Persons traveling with the contractual partner (e.g., family members, friends, etc.) are also considered guests.  <\/p>\n<p>&#8220;Contractual Partner&#8221; refers to any natural or legal person who concludes a contract with the Hotel as a client. Insofar as the following provisions refer to the &#8220;contractual partner,&#8221; this\u2014unless explicitly distinguished otherwise\u2014always includes the guest as well as any fellow travelers and persons registered by the contractual partner. <\/p>\n<p>&#8220;Entrepreneur&#8221; or &#8220;Consumer&#8221;: These terms are to be understood in the sense of the Austrian Consumer Protection Act (KSchG).<\/p>\n<p>&#8220;Contract&#8221;: Refers to the accommodation contract or contract for any other service concluded between the Hotel and the contractual partner.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>3. Conclusion of Contract<\/strong><\/p>\n<p>3.1 The accommodation contract is concluded upon the Hotel&#8217;s acceptance of the contractual partner&#8217;s order. Electronic declarations are deemed to have been received as soon as they can be accessed under normal circumstances and receipt occurs during the Hotel&#8217;s stated business hours. <\/p>\n<p>3.2 The Hotel is entitled to make the conclusion of the contract dependent on the payment of a deposit or a credit card authorization (payment guarantee). In this case, the contractual partner will be informed of this before the contract is concluded. If the contractual partner does not provide the agreed deposit or credit card authorization on time, the Hotel is entitled to withdraw from the contract without setting a grace period.  <\/p>\n<p>3.3 Unless a different period has been agreed upon, the deposit or credit card authorization must be provided (received) no later than within the period specified in the booking confirmation. Any costs associated with the money transaction (e.g., transfer fees) shall be borne by the contractual partner. <\/p>\n<p>3.4 The deposit is considered a partial payment of the agreed total fee.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>4. Start and End of Accommodation<\/strong><\/p>\n<p>4.1 Unless a different check-in time was agreed upon in the booking confirmation, the contractual partner has the right to occupy the rented rooms from 4:00 PM on the agreed day of arrival.<\/p>\n<p>4.2 If a room is occupied for the first time before 6:00 AM, the preceding night counts as the first overnight stay.<\/p>\n<p>4.3 The rented rooms must be vacated by the contractual partner by 10:00 AM at the latest on the day of departure, unless a different agreement has been made.<\/p>\n<p>4.4 Without a separate agreement, there is no entitlement to earlier provision or later use of the rooms.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>5. Priority of Individual Agreements<\/strong><\/p>\n<p>5.1 The specific service contents result from the respective booking confirmation.<\/p>\n<p>5.2 This particularly concerns:<\/p>\n<ul>\n<li>Prices<\/li>\n<li>Booked services<\/li>\n<li>Duration of stay<\/li>\n<li>Cancellation conditions<\/li>\n<li>Arrival and departure times<\/li>\n<\/ul>\n<p>5.3 Individual agreements take precedence over these GTC.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>6. Withdrawal by the Contractual Partner (Cancellation)<\/strong><\/p>\n<p>6.1 No later than 31 days before the agreed arrival date of the guest, the contract may be terminated by unilateral declaration of the contractual partner without payment of a cancellation fee.<\/p>\n<p>6.2 Unless otherwise agreed in individual contracts, withdrawal by the contractual partner is only permitted if the following cancellation fees are paid:<\/p>\n<ul>\n<li>30 to 15 days before arrival: 30% of the total amount of the booked stay<\/li>\n<li>14 to 7 days before arrival: 50% of the total amount of the booked stay<\/li>\n<li>7 days until the day of arrival: 80% of the total amount of the booked stay<\/li>\n<\/ul>\n<p>6.3 The receipt of the withdrawal declaration by the Hotel is decisive.<\/p>\n<p>6.4 In the event of a no-show or premature departure, the Hotel is entitled to charge the entire agreed amount.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>7. Withdrawal by the Hotel<\/strong><\/p>\n<p>7.1 If the accommodation contract provides for a deposit or credit card authorization (payment guarantee) and this was not provided by the contractual partner on time, the Hotel is entitled to withdraw from the contract without setting a grace period.<\/p>\n<p>7.2 If the guest does not appear by 9:00 PM on the agreed day of arrival, there is no obligation to provide accommodation unless a later arrival time was expressly agreed upon.<\/p>\n<p>7.3 If a deposit or credit card authorization has been provided, the booked rooms remain reserved until 10:00 AM at the latest on the day following the agreed arrival date. In the case of advance payment for more than four nights, however, the obligation to provide accommodation ends at 6:00 PM on the fourth day, with the day of arrival counting as the first day, unless the guest announces a later arrival time. <\/p>\n<p>7.4 The Hotel is entitled to terminate the accommodation contract by unilateral declaration for objectively justified reasons no later than 3 months before the agreed arrival date, unless a different agreement has been made.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>8. Obstruction of Arrival<\/strong><\/p>\n<p>8.1 If the guest cannot appear at the Hotel on the day of arrival due to unforeseeable and extraordinary circumstances beyond their control (e.g., extreme weather conditions, natural events, or comparable cases of force majeure) and arrival is thus objectively impossible, the contractual partner is not obliged to pay the agreed fee for the duration of the impossibility.<\/p>\n<p>8.2 The obligation to pay for the booked stay resumes from the point in time at which arrival is objectively possible, provided this occurs within three days of the cessation of the obstacle.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>9. Rights of the Contractual Partner<\/strong><\/p>\n<p>9.1 By concluding the accommodation contract, the contractual partner acquires the right to use the rented rooms and the generally accessible facilities of the respective hotel within the scope of normal use.<\/p>\n<p>9.2 The use of the facilities occurs in consideration of the respective operating hours, safety regulations, and any usage rules of the Hotel.<\/p>\n<p>9.3 The contractual partner is obliged to comply with the currently applicable house rules and any guest guidelines of the Hotel.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>10. Obligations of the Contractual Partner<\/strong><\/p>\n<p>10.1 The contractual partner is obliged to pay the agreed total price for the booked stay in full by arrival at the latest, unless a different agreement has been made. This includes, in particular, all agreed overnight, catering, and other booked services. Services used additionally during the stay, in particular restaurant, bar, minibar, wellness, or other additional services, will be charged separately and are due for payment by departure at the latest.  <\/p>\n<p>Deposits already paid will be credited against the total price.<\/p>\n<p>10.2 The Hotel is not obliged to accept foreign currencies. If foreign currencies or cashless means of payment are accepted, this will be done, where possible, at the current daily exchange rate. All associated costs, in particular fees from credit card companies or other payment service providers, shall be borne by the contractual partner.  <\/p>\n<p>10.3 The contractual partner is liable to the Hotel for all damages caused by themselves, the guest, or other persons who make use of the Hotel&#8217;s services with their knowledge or will.<\/p>\n<p>10.4 The contractual partner is obliged to inform the Hotel immediately of any damage or defects that occur and to do everything reasonable to prevent the damage from increasing.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>11. Rights of the Hotel<\/strong><\/p>\n<p>11.1 If the contractual partner defaults on payment of the agreed fee or refuses payment, the Hotel is entitled to the statutory rights of retention and lien pursuant to \u00a7\u00a7 970c and 1101 ABGB (Austrian General Civil Code) on the items brought in by the guest to secure its claims from the accommodation contract\u2014in particular for lodging, catering, and other services. This also applies to claims from any compensation claims. <\/p>\n<p>11.2 For services provided in the room or outside of normal operating or service hours, a reasonable special fee may be charged. This will be announced in advance in a suitable manner (e.g., price list, digital guest information). There is no entitlement to the provision of such services. The Hotel is entitled to refuse these for operational, personnel, or organizational reasons.   <\/p>\n<p>11.3 The Hotel is entitled to invoice its services at any time or to issue interim invoices.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>12. Obligations of the Hotel<\/strong><\/p>\n<p>12.1 The Hotel is obliged to provide the agreed services to an extent corresponding to the booked category and the standard of the respective hotel.<\/p>\n<p>12.2 The Hotel provides the booked rooms for the agreed duration. Unless a specific room number has been expressly promised in writing, there is no entitlement to a specific room, but only to the booked room category. <\/p>\n<p>12.3 Services that are not expressly included in the agreed fee will be charged separately. These include in particular: <\/p>\n<ul>\n<li>The use of special facilities (e.g., wellness areas, fitness rooms, parking spaces, or garages), unless these are identified as included services.<\/li>\n<li>The provision of extra beds or cribs as well as additional services such as room service, minibar, or laundry service.<\/li>\n<li>The use of seminar or event rooms as well as other separately agreed services.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>13. Liability<\/strong><\/p>\n<p>13.1 As an innkeeper, the Hotel is liable for the items brought in by the contractual partner in accordance with the statutory provisions of \u00a7\u00a7 970 ff ABGB. Liability only exists if the items have been handed over to the Hotel or to persons authorized by the Hotel or have been brought to a place designated or intended for this purpose by them. <\/p>\n<p>13.2 Liability for valuables, money, and securities is limited to the currently applicable statutory maximum amount (currently approx. EUR 550), unless the Hotel has taken over these items for safekeeping with knowledge of their nature or the damage was caused by the Hotel or its staff. For other items brought in, liability is limited to the maximum amount provided for by law. <\/p>\n<p>13.3 The Hotel recommends storing valuables, money, and securities in the room safe or\u2014if available\u2014in the main safe at reception. Any further liability for items kept in the room or left out in the open is excluded within the scope of the statutory provisions. <\/p>\n<p>13.4 Claims from innkeeper liability must be asserted against the Hotel immediately after knowledge of the damage. Liability expires if the guest does not report the damage immediately after knowledge (\u00a7 970b ABGB), unless the items were expressly taken over by the Hotel for safekeeping. <\/p>\n<p>&nbsp;<\/p>\n<p><strong>14. Limitations of Liability<\/strong><\/p>\n<p>14.1 Liability towards Consumers<\/p>\n<p>Towards consumers within the meaning of the Consumer Protection Act, the Hotel is only liable for damages in the event of intent and gross negligence. This does not apply to personal injury or to damage to items taken over for processing, or in cases of mandatory statutory liability, in particular according to the provisions on innkeeper liability (\u00a7\u00a7 970 ff ABGB). <\/p>\n<p>14.2 Liability towards Entrepreneurs<\/p>\n<p>Towards entrepreneurs, the Hotel&#8217;s liability for slight negligence is excluded. Liability for gross negligence is\u2014as far as legally permissible\u2014limited to the damage foreseeable at the time of conclusion of the contract and typically occurring. Liability for lost profit, indirect damage, and consequential damage is excluded. The contractual partner bears the burden of proof for the existence of fault exceeding slight negligence.   <\/p>\n<p>&nbsp;<\/p>\n<p><strong>15. Keeping of Animals<\/strong><\/p>\n<p>15.1 Bringing animals requires the prior consent of the Hotel.<\/p>\n<p>15.2 The Hotel is entitled to charge a separate fee for this.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>16. Extension of Accommodation<\/strong><\/p>\n<p>16.1 The contractual partner has no right to an extension of the stay. If the request for an extension is announced in good time, the Hotel may agree to an extension. There is no obligation to do so.  <\/p>\n<p>16.2 If the contractual partner cannot leave the Hotel on the day of departure due to unforeseeable and extraordinary circumstances (e.g., extreme weather conditions or comparable cases of force majeure) and departure is objectively impossible, the accommodation contract is automatically extended for the duration of the impossibility. A reduction of the fee is only possible if the contractual partner cannot fully use the offered services as a result of these circumstances. The Hotel is entitled to charge at least the fee that corresponds to the usual price level of the low season.  <\/p>\n<p>&nbsp;<\/p>\n<p><strong>17. Termination of the Accommodation Contract \u2013 Premature Dissolution<\/strong><\/p>\n<p>17.1 If the accommodation contract was concluded for a fixed term, it ends upon expiry of the agreed duration.<\/p>\n<p>17.2 If the contractual partner departs prematurely, the Hotel is entitled to demand the agreed fee.<\/p>\n<p>In this case, what the Hotel has saved as a result of the non-use or has achieved through other rental will be deducted.<\/p>\n<p>17.3 The accommodation contract with a guest ends upon their death.<\/p>\n<p>17.4 The Hotel is entitled to dissolve the accommodation contract with immediate effect for good cause, in particular if the guest:<\/p>\n<p>a) Significant misconduct:<\/p>\n<p>uses the premises in a significantly detrimental manner or makes the stay unreasonable for other guests, employees, or third parties through reckless, offensive, or grossly improper behavior;<\/p>\n<p>b) Criminal acts:<\/p>\n<p>is guilty of a criminal act against the aforementioned persons or their property or credibly threatens such an act;<\/p>\n<p>c) Health hazard or need for care:<\/p>\n<p>suffers from a contagious disease that poses a danger to third parties, or becomes in need of care and proper care in the Hotel cannot be guaranteed;<\/p>\n<p>d) Default of payment:<\/p>\n<p>does not settle due invoices immediately despite being requested to do so or does not provide agreed deposits or securities on time.<\/p>\n<p>17.5 If the fulfillment of the contract becomes impossible due to an event of force majeure (e.g., natural events, strike, official measures), the Hotel is entitled to dissolve the contract at any time without observing a notice period, unless a statutory dissolution already occurs or the Hotel is released from its obligation to perform.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>18. Illness of the Guest<\/strong><\/p>\n<p>18.1 If a guest falls ill during their stay at the Hotel, the Hotel will provide medical care at the guest&#8217;s request. If there is danger in delay, the Hotel will arrange for appropriate measures even without an express request. <\/p>\n<p>18.2 As long as the guest is not able to make decisions themselves and relatives cannot be reached, the Hotel will provide necessary medical care at the guest&#8217;s expense. This obligation ends as soon as the guest is capable of making decisions again or relatives have been informed. <\/p>\n<p>18.3 The Hotel is entitled to compensation from the contractual partner or the guest or, in the event of death, from their legal successors, in particular for the following costs:<\/p>\n<p>a) medical treatment costs, patient transport, medication, and medical aids;<\/p>\n<p>b) necessary room disinfection;<\/p>\n<p>c) replacement or cleaning of damaged or contaminated linen, bedding, and furnishings;<\/p>\n<p>d) restoration of rooms and facilities insofar as these were impaired in connection with illness or death;<\/p>\n<p>e) room fee for the duration of use as well as for any times of unusability (e.g., due to necessary disinfection);<\/p>\n<p>f) other damages incurred by the Hotel.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>19. Vouchers<\/strong><\/p>\n<p>19.1 Scope of Application<\/p>\n<p>The following provisions apply to the purchase and redemption of vouchers purchased via the voucher shop or directly from the Hotel.<\/p>\n<p>19.2 Conclusion of Contract<\/p>\n<p>The contract for the purchase of a voucher is concluded by the contractual partner&#8217;s order and acceptance by the Hotel. The Hotel is entitled to make the conclusion of the contract dependent on full receipt of payment. An entitlement to the issuance and transmission of the voucher only exists after full payment.  <\/p>\n<p>19.3 Voucher Types<\/p>\n<p>The Hotel offers value vouchers as well as vouchers for specific services or arrangements. Vouchers for specific services or arrangements merely represent a service recommendation and are offset in terms of value. There is no entitlement to the provision of a specific service unless this has been expressly agreed.  <\/p>\n<p>19.4 Redemption<\/p>\n<p>Vouchers can only be redeemed for services provided by the Hotel. Cash redemption of vouchers is excluded. Partial redemption of value vouchers is possible. Any remaining balance remains on the voucher. The General Terms and Conditions for accommodation services of the Hotel apply additionally to the redemption of vouchers.    <\/p>\n<p>19.5 Validity<\/p>\n<p>Unless a shorter period of validity has been expressly agreed, vouchers are valid for 30 years. If a shorter period of validity is specified in individual cases (e.g., for promotional vouchers), this shall take precedence. <\/p>\n<p>19.6 Right of Withdrawal<\/p>\n<p>If the contractual partner is a consumer within the meaning of the KSchG, they are entitled to a statutory right of withdrawal. The detailed provisions on the right of withdrawal result from the separate withdrawal policy provided to the contractual partner during the ordering process. <\/p>\n<p>19.7 Loss and Misuse<\/p>\n<p>Vouchers are to be treated like cash. The Hotel assumes no liability in the event of loss, theft, or misuse. Blocking or reissuing vouchers is excluded.  <\/p>\n<p>&nbsp;<\/p>\n<p><strong> 20. Data Protection<\/strong><\/p>\n<p>The Hotel&#8217;s separate <a href=\"https:\/\/wrann.at\/en\/privacy-policy\/\">privacy policy<\/a> applies.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>21. Place of Performance, Jurisdiction, and Law<\/strong><\/p>\n<p>21.1 The place of performance is the location where the respective hotel is situated.<\/p>\n<p>21.2 This contract is subject to Austrian substantive law, excluding the conflict-of-law rules of international private law (in particular IPRG and Rome I Regulation) and the UN Convention on Contracts for the International Sale of Goods.<\/p>\n<p>21.3 Jurisdiction for Entrepreneurs<\/p>\n<p>Towards contractual partners who are entrepreneurs within the meaning of the UGB (Austrian Commercial Code), the court with subject-matter jurisdiction at the registered office of Wrann Hotels GmbH is agreed as the exclusive place of jurisdiction. However, the Hotel is also entitled to assert its claims at its own discretion at the court responsible for the registered office of the contractual partner. <\/p>\n<p>21.4 Jurisdiction for Consumers<\/p>\n<p>Towards consumers, only the statutory places of jurisdiction apply. Actions against consumers can only be brought at their place of residence, habitual residence, or place of employment. <\/p>\n<p>&nbsp;<\/p>\n<p><strong> 22. Final Provisions<\/strong><\/p>\n<p>22.1 Limitation Period<\/p>\n<p>Towards contractual partners who are entrepreneurs, the limitation period for all claims from the accommodation contract is one year from the legally provided start of the period. Towards consumers, the statutory limitation provisions apply. <\/p>\n<p>22.2 Offsetting<\/p>\n<p>The Hotel is entitled to offset its own claims against claims of the contractual partner. The contractual partner is only entitled to offset if their counterclaim has been established by a court, recognized by the Hotel, or if the Hotel is insolvent. <\/p>\n<p>22.3 Severability Clause<\/p>\n<p>Should individual provisions of these GTC be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected.
